PURCHASE AGREEMENT
THIS AGREEMENT is made between ___CHAD PRESLEY__, of _____ _______, KS
(“BUYER”) and William & Darlene Worthington, residing in Arlington, KS (“SELLER”) for the
purchase described below.

1. PURCHASE PRICE
For the total sum of $2500, Seller agrees to sell and Buyer agrees to buy the horse(s) listed
above based on the terms to follow.
2. WARRANTIES
( a ) Seller covenants that he/she is the lawful owner of said horse, that he/she has the right to
sell the horse and that he/she will warrant and defend the horse against lawful claims and
demands of all persons.
( b ) Seller makes no other promises, express or implied, including warranties of fitness and
health , nor suitability of horse to rider for a particular purpose unless further provided in
section 6. Buyer has option of having a veterinarian's examination done at buyer’s expense.
This examination must be performed before shipment.
( c ) Buyer is responsible for all veterinary, testing and transportation, planning and expenses
unless specified in section 6
( d) Transfer of Ownership: Once seller has received payment in full, Seller shall transfer
ownership and sign registration papers, if applicable, for transfer of said horse to the Buyer
unless specified in section 6. Any and all transfer fees shall be the obligation of the Buyer.
3. GOVERNING LAWS
The terms of this agreement shall be governed by the laws of the State of Kansas. Any legal
action must be brought in Reno County.
4. BREACH
Either party may nullify this Agreement if the other party breaches a material term of this
Agreement. The wronged party may recover reasonable attorney’s fees and court costs.
5. ALL SALES ARE FINAL and AS IS unless special provisions are made in Section 6 below.
6. SPECIAL PROVISIONS AND/OR CONTINGENCIES OF THIS SALE:
Deposit in the amount of $500. Horse will be free boarded for 30 days at PPF while shipping
arrangements are made; after 30 days board will accrue at $200 per month, vet and farrier not
included. Transportation arranged by Buyer. Registration papers released upon payment in
full.
Payments due on the 15th of the month, in the amount of $350 per month, until paid in full.
Any payments more than 14 days late may be construed as default of contract by Seller and
all moneys and this purchase agreement will be forfeited. Buyer agrees that Seller is not
responsible for vet care, emergencies, or death of horse(s) while at the Seller’s facility.
Equine Mortality Insurance is recommended. Seller will provide proper care while the horse is
at the Seller’s facility. Seller will notify Buyer if either horse requires emergency medical
treatment. Buyer accepts responsibility for all veterinary expenses for the horse as of the date
of this agreement.
7. DESCRIBED HORSE in this purchase agreement has been represented to the buyer to the
best of the Seller’s knowledge and experience of this horse.
8. ENTIRE AGREEMENT
This constitutes the entire Agreement between the parties. Any modifications or additions
MUST be in writing and signed by both parties to this Agreement. No oral modifications or
additions will be considered to be a part of this Agreement unless reduced to writing and
signed by both parties.
